Terms of use
Who are these terms with?
TerraBrain is operated by Terralox ("we", "us"). These terms are an agreement between you and Terralox. By using the site, the AI guide or any connected tool, you agree to them. If you create an account or buy a subscription, you will be asked to agree by checking a box, and we keep a record of the version you accepted. If you do not agree, do not use the service.
Who can use TerraBrain?
You must be at least 18 years old, or use the site with a parent or guardian who agrees to these terms. Businesses may use it through a person authorized to accept these terms for them.
What is TerraBrain?
TerraBrain is an information service about foundation, drainage and plumbing-leak problems in Oklahoma homes. It has a library of sourced articles and an AI guide that answers questions in conversation. Some tools and higher usage levels may require a free account or a paid subscription.
Is this professional advice?
No. Everything on this site, including AI answers, is general information. It is not engineering, legal, insurance, real-estate or financial advice, it is not an inspection of your home, and using the site does not create a professional or client relationship with anyone. Foundation conditions vary from lot to lot. Before you repair, buy, sell, sign a contract or file a claim, have the property evaluated in person by a qualified professional, such as a licensed professional engineer. You are responsible for your own decisions.
Can the AI guide be wrong?
Yes. Answers are generated automatically and can misunderstand a question, leave out something important, or be incorrect or out of date. Check important points against the cited sources and with a professional. If anything sounds unsafe (a gas smell, walls or ceilings moving, cracks growing quickly, doors that suddenly will not open), leave the area and call the right professional or emergency service right away. Do not rely on the site in an emergency.
Does TerraBrain recommend companies or show ads?
The AI guide does not name or recommend repair companies, and library articles are written from cited sources, not from advertisers. Case studies come from real Oklahoma job records and engineer reports with names, addresses and companies removed. We may offer sponsored listings or advertising. Anything paid for will be clearly labeled "Sponsored" and kept separate from the library and the AI guide's answers. A sponsored listing is not an endorsement, and you should check any company yourself (license, insurance, references, written warranty).
How do accounts work?
Keep your login private and tell us right away if you think someone else is using your account. You are responsible for activity on your account. Give accurate information when you sign up. We may suspend or close an account that breaks these terms, is used for abuse, or has an unpaid balance.
How do subscriptions and payments work?
- Plans. Free and paid plans, their prices and what each includes are shown before you buy. We decide which tools and usage levels are included in each plan and may change plan contents going forward.
- Billing. Payments are processed by Stripe. Paid plans renew automatically each billing period at the then-current price until you cancel. You authorize us to charge your payment method for each renewal.
- Cancelling. You can cancel at any time. Access continues to the end of the period you already paid for, and you will not be charged again.
- Refunds. Payments are non-refundable, including for partly used periods, except where the law requires a refund or where we decide to give one.
- Price changes. We will give at least 30 days' notice by email before a price increase applies to your plan. You can cancel before it takes effect.
- Usage limits. Each plan has limits on AI questions. When you reach a limit, you may need to wait, upgrade or buy more.
- Taxes. Prices may not include applicable taxes.
What is not allowed?
Do not scrape or automate the AI guide, get around usage limits, the bot check or plan access, share or resell an account, try to make the guide produce harmful, unlawful or unrelated content, upload anything you do not have the right to share, enter other people's personal information, or interfere with the service. The library pages and the files listed on the About page may be read and cited by search engines and AI systems.
Who owns the content?
The site, its design, the library's writing and the tools belong to Terralox. You may quote and link to articles with credit to TerraBrain and a link to the page; please cite the original sources too. Do not copy the library wholesale or present it as your own. If you send feedback or suggestions, we may use them to improve the service without owing you anything.
What about other websites?
Articles link to outside sources. We do not control those sites and are not responsible for their content.
Is there a warranty?
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not promise the service will be uninterrupted or error-free.
What is the limit of liability?
To the fullest extent the law allows, Terralox and the people behind it are not liable for indirect, incidental, special, consequential or punitive damages, or for property damage, repair costs, lost value or lost profits, arising from your use of the site, the AI guide or any tool. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places do not allow these limits, so they apply only as far as the law permits.
Do I have any responsibility to you?
Yes. If you break these terms or misuse the service and that leads to a claim against us, you agree to cover our reasonable costs and losses from that claim, including attorney's fees.
How are disputes handled?
- Talk first. Email info@terralox.com and give us 30 days to try to fix it informally.
- Arbitration. If that does not work, disputes will be settled by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, instead of in court. Either side may still use small-claims court for a claim that qualifies.
- No class actions. Claims may be brought only individually, not as part of a class or group action.
- Opting out. You can opt out of arbitration by emailing us within 30 days of first accepting these terms with the subject "Arbitration opt-out".
- Law and place. These terms are governed by Oklahoma law. Any court case allowed under these terms will be filed in Tulsa County, Oklahoma.
Can these terms change?
Yes. The date at the top shows the current version. For important changes we will give notice on the site or by email, and account holders may be asked to accept the new version. Continuing to use the service after a change means you accept it.
What else should I know?
If part of these terms is found unenforceable, the rest still applies. Not enforcing a term right away does not waive it. These terms, the Privacy page and any plan details shown at purchase are the whole agreement between you and us about the service.
